Terms Of Service

These Terms of Service apply to all clients engaging SOUNDMODA UK LTD and Worldwide Sounds Pty Ltd (“SOUNDMODA”, “we”, “us”). By booking or using our services, you agree to these terms. Full service agreements are provided to clients before project commencement.
1. Services
We provide custom music production services including original compositions, remixes, edits, mashups and mixes. Deliverables are provided as “Mixed Recordings” in accordance with agreed briefs and timelines.
2. Fees & Payment

Fees are agreed before each project and invoiced accordingly.

Payment is required upon receipt of invoice (unless otherwise agreed).

Work may be paused or withheld if invoices are unpaid.
3. Copyright & Licenses

SOUNDMODA does not provide sync or usage licenses for third-party copyrighted material.

Customers are responsible for supplying any song files used in custom mixes and for securing all necessary licenses for their intended use.

SOUNDMODA UK LTD and Worldwide Sounds Pty Ltd, including its employees, contractors and partners, will not be held liable for any claims, damages, or costs arising from the use of third-party material provided by clients.

All new intellectual property created by SOUNDMODA in the course of a project remains owned by SOUNDMODA and is licensed to the customer, unless otherwise agreed.
4. Usage of Mixed Recordings

Clients receive a non-exclusive license to use the Mixed Recordings for live performances, rehearsals, competitions or approved uses.

Mixed Recordings must not be resold, redistributed, or used outside of the approved purpose without written consent.
5. Cancellations & Termination

Either party may terminate a project in writing.

Fees remain payable for work completed up to the termination date, including expenses incurred.
6. Warranties & Liability

We provide services to the best of our ability but make no guarantees on fitness for a particular purpose.

Clients indemnify SOUNDMODA against claims arising from their use of Mixed Recordings or failure to obtain necessary licenses.

To the maximum extent permitted by law, our liability is limited to the fees paid for the services.
7. Marketing
Unless otherwise agreed, SOUNDMODA may use client names, recordings, likeness, images and logos in its portfolio and marketing materials.
8. Governing Law

For SOUNDMODA UK LTD, these terms are governed by the laws of England & Wales.

For Worldwide Sounds Pty Ltd, these terms are governed by the laws of Queensland, Australia.
⚠️ Important: This condensed version is for general reference. Clients entering into specific projects with SOUNDMODA will be provided with a full Service Agreement that contains detailed terms and conditions.
